Terms & Conditions Terms and Conditions Applying to the Use of Bookings4-u by the Subscriber/accommodation provider Bookings made with the Bookings4-u System All bookings made with the Bookings4-u System form a contract only between the subscriber/accommodation provider and the parties making the booking. Bookings4-u is specifically not a party to any such booking contract and accepts no liability for any claims or complaints made against the accommodation provider. Prices and Payment The Subscriber/accommodation provider acknowledges that bookings4-u does not have any control over the prices the Subscriber/accommodation provider charges to their clients making use of the Services. Display of Cancellation Policy It is a condition of the use of the bookings4-u system and Services that the Subscriber/accommodation provider will display a clear and unambiguous cancellation policy fully compliant with any necessary legal requirements by entering the details in the appropriate section of the Administration facility of the Services. Bookings4-u is not liable for any disputes arising between the subscriber/accommodation provider and their customers as a result of implementing this policy. Quality of Accommodation The Subscriber/accommodation provider acknowledges bookings4-u has no responsibility for problems arising from the quality of accommodation or service provided to clients making bookings through the Bookings4-u system. Accuracy of Information Bookings4-u and its suppliers have taken reasonable care to ensure that the content of the website delivering the Services is accurate. The Subscriber/accommodation provider acknowledges and accepts that bookings4-u cannot be held responsible for any inaccuracies in such information. Bookings4-u is not responsible for any information which the Subscriber/accommodation provider may enter into the Bookings4-u system. No Guarantee of Continuous Access to bookings4-u Bookings4-u cannot guarantee continuous access without interruption to its Services, nor do bookings4-u guarantee secure access to its services. The performance of bookings4-u may be interfered with by many factors outside our control. No liability for any losses incurred by the subscriber/accommodation provider from interruption to or corruption of the Services will be accepted under any circumstances. Complaints Any complaint regarding the business activities of the Subscriber/accommodation provider is not the responsibility of bookings4-u. Indemnity The Subscriber/accommodation provider agrees to indemnify and hold harmless bookings4-u from and against any liability damage or loss including legal fees and expenses that are incurred as a result of any action, inaction or omission by the Subscriber/accommodation provider. Consequential Loss Under no conditions and in no event shall bookings4-u or its suppliers be liable for any consequential or special damages or losses, however arising (including, but not limited to negligence or breach of this terms and conditions or otherwise) or for any loss of property, data, profit, revenue or business, however caused even if that loss or damage was foreseeable by or the possibility of it was brought to the attention of bookings4-u. Limitation of Liability Notwithstanding the forgoing, bookings4-u liability to the Subscriber/accommodation provider in any and all circumstances are limited to the lesser or either::- The amount paid by the Subscriber/accommodation provider for the initial set up of the Services excluding any regular monthly licence fees, or £250.00 - whichever is the lesser. Assignment The Subscriber/accommodation provider may not assign, convey, subcontract or delegate any rights, duties or obligations hereunder except with the written consent of Bookings4-u. Intellectual Property The Subscriber/accommodation provider acknowledges that all copyright, trademarks and other intellectual property rights in and relating to the Bookings4-u system are solely owned by or licensed to bookings4-u. The content or data found on the system may not be reproduced, sold, transferred or modified without the prior written consent of bookings4-u. Neither may the Subscriber/accommodation provider modify, duplicate, display, copy, reproduce, license, publish, transfer or sell any information, software, products or services obtained from the system without the prior written consent of bookings4-u. The Subscriber/accommodation provider further acknowledges that he/she must not use any of these intellectual property rights, or the Bookings4-u Services, except to the extent necessary to use the Services in the manner anticipated by these terms and conditions. General Conditions applying to these terms and Conditions Amendment to These Terms and Conditions Bookings4-u reserve the right to amend these Terms and Conditions at any time. Updates will be effective 5 days after they are posted on the bookings4-u website. Headings The headings used in these Terms and Conditions are included for convenience only and shall not define, extend, limit or otherwise affect these Terms and Conditions. Entire Agreement These terms contain the entire agreement between bookings4-u and the Subscriber/accommodation provider and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified unless expressly agreed by bookings4-u in writing..
